THE buying PROCESS

Register with us

Our agents will need as much information as possible about the type of property you are looking for and will do their very best to find your ideal home or dream property.

Lender

If a you need a mortgage, we recommend that you get a pre-approval as soon as possible, this would aid in the process of helping you identify your budget.

Viewings

An appointment is made for a viewing to be conducted. Weekends are included providing the owner has agreed.

Make An Offer

Once a suitable property is found, your offer is put forward to the owner immediately. Offers are subject to a contract being signed. There are no legal obligations on either side until a contract is signed.

Legalities

The legal work must be handled by a local attorney. On Point Property Management & Concierge will be pleased to recommend one of the attorneys we have worked closely with over the years if you do not already have one.

If your offer is accepted

Your attorney must be instructed to proceed if your offer is approved. We'll try to reach an exchange and completion date at this point. Additionally, this is the moment to tell your mortgage broker to move forward with your mortgage application and set up a valuation.

This is prepared by the seller's attorney and delivered to your attorney, who will conduct a land registry search and make some initial inquiries.

Once results of the local search and answers to the preliminary enquiries are received, the draft contract is approved by your Attorney providing there are no further enquiries.

Formal Mortgage offer

Your attorney will receive this paperwork for your signature. Your mortgage will be in place once the document has been signed and returned, and you can now swap contracts.

EXCHANGE OF CONTRACTS

The contract is signed by both parties. The purchaser's attorney pays the deposit, which is typically 10% of the purchase price, and the completion date is typically specified at this point.

THE COMPLETION

After the exchange of contracts, depending on the needs of each party, this often takes three to six months. Now your attorney transfers the remaining amount, often 90%, to the vendor's attorney.

YOUR ATTORNEY'S PART IN THE BUYING PROCESS

1. After deciding on the lawyer who will represent you, you need to confirm with them how much they will charge. The agreed-upon price of the property is usually the basis for the attorney’s fees.

2. The next step is to legally engage your lawyer by acknowledging their engagement letter by signing and mailing it back. This can be done by email if you’re located abroad. The retainer fee and a 10% down payment of the purchase price will then need to be sent to them. If you live abroad, you can wire money to a designated account. Although the money is not transferred to the vendor until after you have signed the contract, it is very beneficial to your attorney as it serves as proof that you are serious.

3. After that, your attorney informs the seller that you are being represented by them. The vendor’s lawyer will next send your lawyer copies of the title deeds that conform to the standard agreement so they can check them for historical ownership of the property.

4. A date of completion is then agreed upon with the vendor. It is very important that you ensure that this date gives you enough time to receive money that you may be borrowing.

5. After that, a courier will deliver the contract to you, where you must sign it in front of a notary public and send it back to your lawyer.

6. This agreement and the 10% deposit will be sent to the vendor’s lawyer as soon as your attorney gets it.

7. Various steps are followed to check the property for any mortgages or other problems.

8. If necessary, plans are then made to have a Land Surveyor formally point out the property’s borders to you or your agent.

9. Your attorney must then receive the remaining purchase money at least three weeks before the project’s scheduled completion date.

COSTS INCURRED BY THE PURCHASER

For buyers, there is no Property Transfer Tax.

Legal fees for buyers approximately 2 – 2.5% of the purchase price (plus 17.5% VAT).

OFF SHORE MORTGAGES

Timeframe for Local Mortgage Repayment: Up to 30 Years or till Borrower Turns 65 years of age.
Down payments for non-national mortgages often range from 30% to 50%.
Maximum 15-year non-national mortgage repayment period

Fees for mortgage commitment and negotiation: 0.5% to 3%.
If you require a mortgage, life insurance is necessary.
Annual Property Insurance: 0.4% for a home, 0.6% for businesses, and 0.9% for lodging establishments. These rates can be impacted by additional factors like geography, property valuation, and use.

ADDITIONAL IMPORTANT INFORMATION

1. There are no limitations on non-nationals buying real estate in Barbados.

2. There are some formalities for bringing foreign currency into the island as well as for mortgages from outside the country. They must all register with the Barbados Central Bank.

3. Barbados does not impose a capital gains tax. Investors are not charged for the increase in their property’s value.

CHECK LIST:

  • For the purpose of knowing what you can afford, think about pre-qualifying with your lender.
  • Copies of the title deeds and title certificate (be sure the originals will be delivered upon completion).
  • Copy of the property’s lot plan; this shouldn’t be older than 20 years; make sure the original will be sent upon completion.
  • A copy of the most recent certificate, receipt, and land tax bill.
  • A copy of the most recent water bill and, if appropriate, the receipt.
  • A copy of the most recent electricity bill and, if appropriate, the receipt.
  • Copies of all Town Planning requests, authorizations, authorized plans, and certificates of compliance pertaining to the property.
  • Verify that using the property as you intend is not prohibited by covenants.
  • Copies of all leases for the entire property or any individual components, if relevant.
  • If the property has a building, it should be covered by a property insurance policy. It should be in place before you sign the sale and buy agreement, whether you want to use the vendor’s policy or create your own (which is advised).
  • Policy on life insurance (as required by your lender), a copy of your certificate of NIS clearance and one for the potential vendor,
    copies of your and the potential vendor’s BRA clearance certificates.
  • A vendor’s certificate of input tax clearance.
  • Verified copies of all corporate paperwork if you intend to own the property through a corporation (decide beforehand).
  • Think about getting a boundary certificate from your own independent land surveyor.
  • Make sure a civil engineer, electrician, and plumber have examined any buildings.

LAND TAX

HOW LAND TAX IS WORKED OUT;

land that has been improved for residential use

0% on real estate up to $150,000
0.1% on the excess of the increased value over $150,000 but not more than $450,000
0.7% of the excess of the increased value beyond $450,000 but not more than $850,000
1.0% of the increased value over $850,000.

 

*Take notice that the improved value of the land is used to determine how much tax is due on improved land.

Improved Land (for Non-Residential purposes)


0.95% of the increased value of each piece of land with a structure other than a home.
Empty Land

0.8% of the site value of undeveloped land that is smaller than 4,000 square feet, or 371.6 square meters
0.9% on the site value of undeveloped land up to $450,000 and more than 4,000 square feet
1.0% on the site value of undeveloped land over 4,000 square feet and worth over $450,000

*Please note that tax on vacant land is calculated on the site value of the land.
